Terms and Conditions

Travel Haus LLC (“Agency”) and Terms and Conditions (“T&Cs”)

The terms "we", "us", "our", “Travel Haus”, and “Agency” refer to Travel Haus LLC, an Alabama limited liability company. The term "you", or “client” refers to the person visiting our website or booking a trip through us. These T&Cs apply to all services ordered from or rendered by or on behalf of the Agency. By requesting services from Travel Haus, the Client is deemed to have read and accepted the T&Cs as contained in the following paragraphs. The client entering into this agreement is also agreeing to those traveling with the client pursuing the agreement (i.e. spouse, direct family, extended family, friend, and any additional attendees associated with the client). Any direct inquiry from our website or payment constitutes acceptance of these T&Cs. If the Client does not agree with any of the terms, it is the Client’s responsibility to speak to Travel Haus before booking services by Agency.

DEFINITIONS AND INTERPRETATION

1.1 In these T&Cs, the following definitions apply:

Agency: means Travel Haus, LLC.

Benefits: means the benefits made available to Clients by Suppliers.

T&Cs: these terms and conditions as amended from time to time in accordance with clause 10.5.

Client: means you and all Clients on the same booking.

Payment Card: has the meaning given in Clause 3.7.

Request: means a request placed by a Client with Travel Haus for Travel Haus to arrange the supply of goods and/or services from a third party on the Client’s behalf.

Services: means the travel reservation, booking, concierge, and lifestyle management services provided by Travel Haus to its Clients, including hotel accommodations, air transportation, cruises, car rentals, tours, activities, and similar products and services involving any type of leisure, business, or other travel.

Supplier: means a supplier engaged by Travel Haus on behalf of and as agent for a Client to provide goods and/or services to that Client.

1.2 In these T&Cs, the following rules apply:

(a) a person includes a natural person, corporate or unincorporated body (whether or not having separate legal personality);

(b) a reference to a party includes its personal representatives, successors, or permitted assigns;

(c) a reference to a statute or statutory provision is a reference to such statute or statutory provision as amended or re-enacted. A reference to a statute or statutory provision includes any subordinate legislation made under that statute or statutory provision, as amended or re-enacted;

(d) any phrase introduced by the terms including, include, in particular, or any similar expression, shall be construed as illustrative and shall not limit the sense of the words preceding those terms; and

(e) a reference to writing or written includes emails.

2. Client Fees and Payments

2.1 Client Fees payable shall be confirmed to you prior to beginning the Travel Haus planning process. The Client Fee shall be payable in full upon Travel Haus’ acceptance of your trip/project scope. Any increase or decrease to the Client Fees will be communicated directly to the Client in either the next Discovery Call or in writing by email, whichever commences first.

2.2 You acknowledge that your payment of the Client Fee constitutes your expressed request for us to begin to supply you with the Services and you understand and agree to these T&Cs, including all cancellation policies.

2.3 Subject to Clause 2.4, Client Fees are non-refundable.

2.4 Travel Haus reserves the absolute right to cancel or suspend your working relationship where it has reason to do so. If Travel Haus cancels your working relationship, where it is reasonable to do so Travel Haus shall refund the balance of your respective Client Fee.

2.5 Client Fees are due on acceptance of your trip/project and full payment will be taken by Travel Haus by payment by a credit or debit card from which you have authorized us to deduct such payment from (“Payment Card”) in accordance with the relevant invoice.

2.6 Travel Haus reserves the right to refuse to provide the Services should any payment due under these T&Cs not be received.

2.7 Travel Haus may, at your request, purchase goods or services on your behalf. If we act as a credit agent in this regard, you hereby authorize Travel Haus to deduct the credit sum from your Payment Card on file immediately.

2.9 Travel Haus will provide Client-quoted rates for Services Requested based on the precise inclusions provided in writing. The final price is subject to change due, without limitation, to inflation, labor or material shortage, foreign exchange market fluctuation, fuel charges, taxes, or a combination thereof, without notice until full payment is received. While Travel Haus will always endeavor not to change the price of a confirmed itinerary, we reserve the right to amend the price where required.

2.10 Unless specifically itemized on your travel documentation, rates do not include Travelers’ costs, fees, or taxes incurred for or related to:

Airports, ports, stations, security, agriculture, customs, immigration, visas, passports, or any other government-imposed taxes or fees, without limitation; or

Meals, beverages, alcohol, minibars, entertainment, seat assignments, upgrades, excursions, hospitality, gratuities, copies, telecommunications, energy, laundry, cleaning, bedding, parking, valet, insurance, taxis, transfers, porterage, departures, travel segments, health, medical tests or treatment, vaccinations, pharmaceuticals, supplements, or any miscellaneous charges of a personal nature, without limitation.

2.8 Travel Haus will communicate the amount of deposit that is required by our partners to secure the reservation. These deposits are non-refundable, unless stated otherwise in the Supplier’s T&Cs. The Deposit is due within five (5) days of making the reservation and until the Deposit is received by Travel Haus there is no binding contract in place.

2.9 With the payment of the Deposit, you will be deemed to have confirmed all the information pertaining to your itinerary as correct and Travel Haus will, subject to availability, make the reservations necessary to secure the Itinerary. Travel Haus reserves the right to cancel any reservation if the Deposit is not received by Travel Haus.

2.10 The Client’s balance is due no later than sixty (60) days prior to departure, or to be confirmed at the time of booking.

2.11 If payments are not received by their due date, all components of the booking may be canceled by the Supplier, which may result in non-refundable previous payments. Agency is not responsible for Supplier fare increases, fees, or penalties incurred due to late payment, all of which must be paid by you.

2.12 No Client will be permitted to travel until full payment is received by Travel Haus or its Supplier.

2.13 Any Request made within sixty (60) days of the start of the trip may be accepted provided space is available and payment in full is received. Travel documents (tickets, vouchers, itineraries, etc.) are only prepared and released once full payment is received by Travel Haus or its Supplier.

2.14 Travel Haus will not accept responsibility for wire transfers or credit card fees.

2.10 Travel Haus conducts business in U.S. Dollars (USD) when possible. In the event that the Supplier does not accept payment in USD, the Client will be charged in the currency of the Supplier’s country. The current exchange rate will be determined either by the Supplier’s payment processing platform or the Client’s bank or credit card institution.

2.12 The terms of your Booking (such as price, availability, and/or dates of travel) are not guaranteed until the contract is formed between you and the Supplier and a ticket and/or a reservation voucher has been confirmed and issued by Supplier.

2.13 It is the Client’s sole responsibility to review their reservation confirmation and verify all aspects of their reservation, including, but not limited to, the following: Client names, mailing address, email address, telephone number(s), date(s) of birth, pricing, airfare, departure/arrival times and airports, accommodations, and organized activities. Please notify the Agency immediately if any errors or omissions exist or other corrections are necessary to adjust or otherwise change your bookings.

2.14 Client(s) voluntarily assume full and sole responsibility for any and all risks and/or costs involved with failure to report such errors or omissions. Clients are required to verify the accuracy of their legal first and last names. it is mandatory that names on bookings be identical to those on all travel documents, such as passport and driver’s license.

2.15 A revision fee of $100 per person will be charged for any alteration or revision made to a confirmed reservation once final documents have been issued. No changes are permitted whatsoever within 30 days of trip departure. Any amendment, change, or revision to an itinerary must be addressed to Travel Haus in writing.

SUPPLY OF SERVICES

4.1 Travel Haus shall supply the Services to the Client in accordance with the Client’s particular Requests, provided that Travel Haus shall not be required to provide or facilitate the supply of goods and/or services that it deems, at its sole discretion, may violate applicable laws, standards and/or regulations, or may offend taste and decency in the relevant jurisdiction.

4.2 Travel Haus shall use its reasonable endeavors to meet any performance dates specified, but any such dates shall be estimates only and time shall not be of the essence for performance of any Services.

4.3 Travel Haus shall have the right to make any changes to the Services which are necessary to comply with any applicable law or safety requirement, or which do not materially affect the nature or quality of the Services, and Travel Haus shall notify the Client in any such event.

4.4 Client acknowledges that Travel Haus reserves the right to accept commissions upon the supply of products or performance of services by any Supplier.

4.6 Telephone calls to Travel Haus may be monitored or recorded for training and quality control purposes.

4.8 Travel Haus shall provide the Services using reasonable care and skill and, as far as reasonably possible, in accordance with Client's Requests and reasonable instructions from time to time.

4.9 Restaurants and clubs:

(a) When Client uses the restaurant booking service Client hereby authorizes us to debit Client's Payment Card for any deposit paid by us on Client's behalf to the restaurant, which is forfeited as a result of Client's cancellation of the booking.

(b) When Client uses the restaurant booking service Client agrees that where Client cancels a restaurant booking within 24 hours of the time the restaurant reservation is made Client shall not be entitled to any refund of any monies paid to secure the booking including the return of any booking deposit.

(c) Travel Haus reserves the right to deny restaurant requests from Clients, if Clients repeatedly fail to honor their bookings or continuously violate cancellation policies.

(d) Admission of Clients to any club premises is at all times at the sole discretion of the club Supplier and Travel Haus shall have no liability where a Client is refused admission to a club.

4.10 Tickets:

(a) Travel Haus may be able to obtain the “best tickets for clients in relation to sold-out events through one of its ticket agent partners. Please note that by instructing Travel Haus to obtain such tickets on Client's behalf, you are agreeing to purchase tickets above face value and the total cost may include a service charge to Travel Haus in respect of our provision of services to obtain the seats for Client. Travel Haus is not the seller of the tickets and is not responsible for fulfillment of Client’s order.

(b) All such tickets and ticket agent partners (who shall be the seller in respect of the transaction) shall have their own terms and conditions (which we suggest the Client should read). Such terms and conditions are likely to include terms, which state that sales of tickets are final and no refunds shall be issued after the purchase has been made. Travel Haus shall not be able to provide Client with any refund or obtain any such refund on Client's behalf.

(c) In the event of a show being canceled directly by the artist/promoter, it may be possible to obtain a refund of the face value of the relevant tickets.

(d) Travel Haus or its ticket agent partner will dispatch Client's tickets through delivery agents at standard rates. Please note that Travel Haus shall not be liable for any failure by delivery agents to deliver Client's tickets.

4.11 Travel:

(a) Travel Haus may arrange accommodations for lodging (e.g., hotels, villas, etc.) or for travel (e.g., aircraft, boat, motor vehicle, etc.). Should there be any conditions such as, but not limited to, natural disasters, adverse weather, labor disputes, political strife, etcetera which may prevent such travel. In these cases, a refund or reimbursement is not guaranteed. However, Travel Haus will provide a refund when possible.

(b) When Client uses the hotel or lodging booking service, Client hereby authorizes Travel Haus to debit Client's Payment Card for any deposit paid by Travel Haus on Client’s behalf to the lodging, which is forfeited as a result of Client’s cancellation of the booking.

4.12 Travel Haus, acting reasonably, reserves the right to withdraw any of the Services and/or to refuse to accept any Requests at its sole discretion.

4.13 If Travel Haus is unable or not obliged to deal with any Request, it will inform the Client as soon as reasonably practicable.

4.14 Travel Haus and its Suppliers reserve the right to substitute hotels, alter the itinerary, withdraw any tour, and/or make any necessary adjustments due to unforeseen conditions.

4.14 Client undertakes that all details Client provides to Travel Haus for the purpose of booking, ordering, or purchasing products or services are correct, that the debit, credit, and/or Payment Card Client uses from time to time is Client’s own, and that Client have sufficient funds to cover the cost of the product or service.

4.15 Accommodations:

Hotel accommodation is subject to availability at the time of reservation.

Amenities such as elevators, air conditioning, bedding size, and similar preferences are not guaranteed at all properties. In addition, even if a property has amenities such as air conditioning or elevators, such amenities are not guaranteed to be operational or available during your stay.

4.16 Reimbursement for lack of amenities is solely the responsibility of the hotel. Agency may elect to act as an intermediary, but it is not responsible for such reimbursement under any circumstances.

4.17 Air Travel:

4.18 Travel Haus acts solely as an intermediary between you and the airline.

4.19 Unless indicated otherwise at the time of booking, airline tickets are highly restrictive, non-refundable, and non-transferable. Modification of Client names, dates, times, routing, or departure/arrival times and airports is at the sole discretion of the airline and, if permitted, will likely be subject to a substantial change fee. Clients are responsible for any and all change fees and for the difference in fare, if applicable.

Most airlines consider a name change to be a cancellation.

You are responsible for excess baggage fees. Travelers are responsible to confirm airline baggage allowances for all flights.

International flights may have different requirements than domestic flights.

Tickets of any kind are payable in full at the time of booking.

Airline tickets, once purchased, may be NON-REFUNDABLE and NON-EXCHANGEABLE, subject to airline terms and conditions.

Agency is not responsible for any loss, accident, injury, delay, defect, omission, or irregularity that may occur, such as changes, additional expenses, and cancellations due to weather conditions, schedule changes, and other changes beyond Agency’s control.

You agree to adhere to safety guidelines of all airlines and hold Agency harmless from any liability due to airline restrictions.

Airline seat assignments are not complimentary on every airline.

Charges for pre-assigned seats in advance of flight time may be subject to additional charges.

Agency cannot guarantee seats in specific locations or next to each other. Seat assignments are strictly based on availability at the time seats are being selected and paid for.

Airlines retain the right to change aircraft and seat assignments at any time.

Agency is not responsible for any changes made by airlines or any additional charges imposed by airlines for any changes to seat assignments after selection and payment.

5.6 Air Travel, Hazardous Materials & Insecticides

All air passengers are prohibited by federal law from bringing hazardous materials aboard aircraft in their luggage or on their person. Violations can result in up to 10 years of imprisonment and significant fines under 49 U.S.C. 5124 (see Page 159 TITLE 49—TRANSPORTATION § 5125 § 5124. Criminal penalty (a) IN GENERAL.—A person knowingly violat). Examples include, without limitation, explosives, compressed gases, flammable fluids and solids, oxidizers, poisons, corrosives, radioactive materials, paints, lighter fluid, fireworks, tear gases, oxygen bottles, and radiopharmaceuticals. You are responsible for understanding and adhering to all requirements regarding hazardous materials and insecticides. Please contact your airline regarding your itinerary and applicable rules.

Due to continual changes in airline baggage policies, please confirm with your airline for up-to-date fees and information. Travel Haus is not responsible for additional fees incurred for checked or overweight baggage, including, but not limited to, golf bags, car seats, equipment, musical instruments, sporting equipment, and oversized luggage, or seating. Temporary or permanent loss is the responsibility of you or the carrier. In the event of damage, late forwarding, theft, or loss of luggage, you should contact the airline and declare the damage, absence, or loss of your personal effects before leaving the airport, and then submit a declaration. Copies of the following documents should be attached to the declaration: travel ticket, baggage check-in slip, and photographs, if available. Agency strongly recommends that you obtain an insurance policy covering the value of your items before departure.

5. Client’s Responsibility of Travel

5.1 Travel Documentation (Passports, Visa, and Driver’s Licenses):

The Transportation Security Administration (TSA) requires all airline passengers to provide:

Secure Flight Passenger Data (SFPD);

Full name as it appears on government-issued identification;

Date of birth;

Gender; and

Redress number (if available).

The name of Travelers on all reservations and travel documents must match the name as it appears on that Traveler’s government-issued identification.

Traveler is responsible for any fees and expenses that may be incurred due to an incorrect name or the denial of travel resulting from incorrect information.

It is each Client’s responsibility to carry a valid passport, which must be valid 6 months beyond Client’s date of return, and obtain/fulfill any necessary visa, vaccinations, or travel requirements for each destination in advance of the departure date.

Refunds will not be issued by Travel Haus in the event a trip is canceled or delayed because the client did not have a valid passport or visa at the time of departure or return, or failed to arrive at the location of departure before the boarding time.

Passport and visa fees are the responsibility of each Passenger. It is recommended that each Passenger’s passport be valid for a period of at least six months after the departure date. In addition, it is each Passenger’s responsibility to ensure that his or her visa is valid for the time period specified for each country the Passenger intends to visit. Client(s) assume the sole responsibility for, and hereby release(s) Agency from, any claims or responsibility for any and all damages incurred as a result of Client’s failure to comply with applicable documentation requirements including, but not limited to, the requirement that all Clients procure and have on their person the proper travel documents at all time. The Agency recommends that Client(s) consult with the appropriate domestic and foreign governmental agencies to determine which current travel documents are required by each country destination.

Please note that effective January 23, 2007, a valid passport will be the only acceptable form of documentation for travel to/from Mexico

You are responsible to be familiar with the laws and rules governing any travel to any country.

You are responsible to determine the documents needed, to acquire such documentation, and to ensure your passport is up to date and valid to enter or exit any country.

Agency may be able to assist you in acquiring the necessary travel documents upon your request. However, Agency is not responsible or liable for your failure to hold visas or documentation or to determine the validity of your passport or any other travel document to enter or exit any country.

5.2 No refunds will be issued for any costs or losses incurred as a result of Client’s failure to obtain or provide required travel documentation.

5.3 Security Measures

Updated information regarding security measures and requirements for air travel are available at www.tsa.gov. Agency highly recommends that Clients check this website well before travel.

Travelers are responsible to confirm current entry and exit requirements and to obtain the necessary travel documentation based on the country of origin, destination, and stops in any additional countries.

Minors of age 17 and under traveling alone or with a single parent may be required to have additional documentation on domestic or international flights.

5.4 Disabilities & Special Needs

If you have disabilities or special needs that may require non-emergency special services, additional support, or disability accommodations, please advise Travel Haus in advance of booking.

If you are unable to use your own wheelchairs, mobility devices, or other medical equipment or devices, rentals may be available, potentially subject to additional charges.

Airlines and other Suppliers may impose charges for additional baggage and may have size restrictions for wheelchairs they can accommodate.

If you travel with a service animal or emotional support animal, Suppliers may require advance arrangements and documentation regarding the animal’s health, training, and related factors.

Countries outside the United States and Canada often apply different laws, rules, regulations, standards, and accommodations for persons with disabilities or special needs.

Travel destinations may have limited medical facilities, limited availability of prescription medications, and limited means to accommodate your disability or special needs. Please consult your health provider prior to planning or booking your travel.

Travel insurance plans may provide access to emergency medical care, medical evacuation, and replacement of prescription medications. Agency strongly recommends the purchase of comprehensive travel insurance.

Agency will make all reasonable efforts to request assistance or arrange for appropriate services or equipment regarding Client disabilities or special needs. However, Agency is not responsible for the failure of Suppliers to meet Traveler needs and expectations.

5.8 Entry Refusal

Countries may restrict entry for persons with criminal records. You are responsible to understand all destination entry laws and to know if you or anyone in your party has a criminal record. Agency does not inquire about Traveler criminal records in the interests of privacy.

Refusal of entry is not a valid reason for cancellation, chargeback, or refund.

5.9 Travel during Pandemics, Epidemics, and other Travel Advisories

You are solely responsible to be fully aware of any restrictions related to pandemics, epidemics, and other travel advisories.

You warrant that you have reviewed and understand all U.S. Center for Disease Control (CDC) and U.S. Department of State travel advisories, notices, warnings, restrictions, and rules, including those regarding pandemics, epidemics, COVID-19, and other health threats.

You are aware that certain countries, including the United States, may require testing and quarantine upon entering the country, as well as testing and quarantine upon returning to the United States or your country of residence.

You understand destination countries may have limited availability of tests required for return to the United States.

Screening procedures and restrictions may take place at airports and in public areas.

Restrictions may include mandatory face coverings and/or temperature checks in airports, hotels, cruise ships, trains, or other means of transport.

You are aware that immigration restrictions may be put in place before or during travel that could impede your ability to enter or exit your destination as planned.

All Clients, including U.S. Citizens, should refer to current CDC guidelines, country-specific guidelines, and Supplier requirements regarding testing and documentation requirements. If you fail to adhere to current regulations or provide any required testing results or documentation, you may be denied boarding, entry, or return to the United States or your country of residence. You are responsible for continually checking the latest CDC and State Department travel advisories, which can be navigated via the following links:

CDC and other governmental notices and policies may change before your travel, during your travel, and after you return from travel. Neither Agency nor Suppliers are responsible for Traveler testing or documentation.

You understand the inherent risks of choosing to travel.

You accept the risks set out above and hold Agency harmless against any travel restrictions, death, illness, cancellations by Suppliers, financial loss, quarantining rules, or measures put in place at airports or destinations you travel through.

You hold Agency harmless for any financial penalties or fees imposed by Suppliers for cancellations or postponements relating to COVID-19, pandemics, epidemics, natural disasters, accidents, or disturbances, or any similar events and you agree not to pursue any credit card charge-back, reimbursement, or legal action against Agency regarding such penalties or fees.

5.10 Travel Insurance

Agency strongly recommends that each Traveler purchase comprehensive travel insurance.

If you decline to purchase travel insurance that includes coverage for medical needs while traveling and coverage for travel delays, you assume all personal risk and financial loss if you cancel your travel or incur costs or losses during the course of travel.

You understand that concerns or fear of pandemics or epidemics are not a covered reason under some travel insurance policies. Insurance policies may exclude coverage for pandemics and epidemics.

Insurance claims will only be paid for covered matters, as stated in the insurance policy.

You hold the Agency harmless for your election not to purchase travel insurance and for any denial of any claim by any insurer for any reasons.

5.11 Travel Haus is not responsible for the value, reliability, quality, or authenticity of any goods purchased while on tour or through Suppliers.

5.12 Travel Haus is not responsible for any acts by third parties or for any mailing, freight, or other shipping arrangements.

CANCELLATIONS, REFUNDS AND RETURNS

6.1 The Client acknowledges that the sales contract for the supply of goods and/or services made as a result of a Request is between the Client and the relevant Supplier and that Travel Haus is not a party to such contract. Cancellation of contracts with Suppliers should be addressed in writing with the Supplier directly and will be subject to the relevant Supplier’s policies.

6.2 Cancellation is only in effect once Travel Haus and its Supplier have received written notification of the cancellation from the Client.

6.3 Should you cancel a trip/booking for any reason, there will be no refunds by Travel Haus, and you will only receive a refund, if any, as provided by Supplier in accordance with the Supplier’s T&Cs.

6.4 A trip reservation often consists of multiple components, each of which may carry its own cancellation penalties (i.e. airline tickets, pre or post-cruise hotel nights, tours, activities, and accommodations) all of which may be subject to a different sets of cancellation policies. Should you cancel your trip, cancellation fees will apply, based on the Supplier’s T&Cs.

6.2 In addition to the relevant Supplier’s fees, charges, and penalties policies, you may be subject to cancellation penalties by Agency of USD 100 per person on the reservation.

6.3 It is for these reasons that we highly recommend appropriate travel insurance to cover cancellation or curtailment of your trip reservation. No refunds will be considered in any circumstances whatsoever, including but not limited to:

(a) lost travel time or substitution of facilities

(b) itineraries amended after departure

(c) if you do not appear for any accommodation, service, sightseeing, or trip segment included in the Itinerary

(d) if you leave your trip after it has begun or for any unused tour services

(e) any circumstances beyond the control of Travel Haus that necessitate alternative arrangements made to ensure the safety or further participation of your trip or due to weather.

6.2 If a Request for a specific product or service is not available, Travel Haus may offer Client substitute products or services of a similar description and standard. Client may at Client’s sole discretion refuse acceptance of such substitute products and/or services and request a full refund in the event that payment has already been made to the Supplier for the unavailable product or service.

6.3 Payment for all products and services shall be due immediately upon acceptance of the order by the relevant Supplier.

6.4 The Client further acknowledges that for goods purchased on his or her behalf by Travel Haus directly from a Supplier, returns, and exchanges will be subject to the terms and conditions of that Supplier, and returns or exchange of goods purchased may not always be permitted. In circumstances where Travel Haus is asked to source a specific item for a Client, Travel Haus shall inform the Client of the refund and exchange policy of that Supplier in advance. Travel Haus shall not be liable to the Client where a Supplier does not accept the return or exchange of an item.

6.5 It shall be the Client’s sole responsibility to retain all proof of return of goods to a Supplier, we recommend returning the goods by registered delivery, or by any other similar means of ascertaining the date of the return dispatch and tracking the return.

6.6 We will inform the Client when we become aware that a refund of an order has been processed by a Supplier.

6.7 Where orders are delivered outside the United States, any applicable customs duties and sales taxes shall not be refundable through Travel Haus. It shall be the Client’s sole responsibility to recover such monies. Travel Haus shall have no liability for any items held by any customs or border agency.

6.9 Failure to travel or show up for any reservation or booking is considered a “no-show”. No-show penalties will be up to the entire cost of travel, subject to the relevant Supplier’s policies.

6.10 You waive any right to a chargeback in case of cancellation (except for fraud) including any Force Majeure event as described in clause 5.10.

6.11 If you attempt a chargeback, reverse charge, or recollection of a travel payment already made without Agency’s authorization, Agency has the right to charge you additional costs, fees, and expenses associated with such chargeback, reverse charge, or recollection, including, without limitation, attorney fees.

SUPPLIERS

7.1 Suppliers are responsible for providing Client with the Services, products, and Benefits Clients Request us to order on Client’s behalf from time to time. Travel Haus shall communicate with Suppliers on Client’s behalf unless it is more appropriate for Client to contact the Supplier directly.

7.2 Suppliers may impose their own terms and conditions, which, in every case apply to the supply of goods and/or services by that Supplier to Client, and such terms and conditions shall be binding upon Client at the time of order.

7.3 When ordering a product or service or accessing a Benefit, Client may be required to provide Client’s Payment Card details. If Client requests and authorizes Travel Haus to use Client’s Payment Card in order to pay a Supplier for products or services, Client acknowledges and agrees that Travel Haus shall have no liability or be responsible in any way whatsoever in respect of the use of Client’s Payment Card provided that Travel Haus acts in accordance with the instructions issued by Client in relation thereof.

7.4 You acknowledge that the Benefits are subject to availability and may change from time to time without notice.

7.5 If Travel Haus’ performance of any of its obligations under these T&Cs is prevented or delayed by any act or omission by the Client or failure by the Client to perform any relevant obligation (Client Default):

(a) Travel Haus shall without limiting its other rights or remedies have the right to suspend performance of the Services until the Client remedies the Client’s Default, and to rely on the Client’s Default to relieve it from the performance of any of its obligations to the extent the Client’s Default prevents or delays Travel Haus’ performance of any of its obligations;

(b) Travel Haus shall not be liable for any costs or losses sustained or incurred by the Client arising directly or indirectly from Travel Haus’ failure or delay to perform any of its obligations as set out in this clause 7.5; and

(c) the Client shall reimburse Travel Haus on written demand for any costs or losses sustained or incurred by Travel Haus arising directly or indirectly from the Client’s Default.

LIMITATION OF LIABILITY

8.1 Nothing in these T&Cs shall limit or exclude Travel Haus’ liability for:

(a) death or personal injury caused by its negligence, or the negligence of its employees, agents, or subcontractors;

(b) fraud or fraudulent misrepresentation; or

(c) breach of the terms implied by section 2 of the Supply of Goods and Services Act 1982 (title and quiet possession).

8.2 Subject to clause 8.1:

(a) Travel Haus shall not be liable to the Client, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for any loss of profits, loss of business, depletion of goodwill and/or similar losses, loss of anticipated savings, loss of goods; or, loss of contract, or loss of use or, loss of corruption of data or information whether direct or indirect or, any special, indirect, consequential or pure economic loss, costs, damages, charges or expenses.

8.3 Your contract for the supply of products or services is made with the relevant Supplier only. Travel Haus acts as an agent for the Supplier and, unless expressly provided otherwise, all Client’s rights and remedies are against the Supplier.

8.4 You acknowledge that any contract entered into by Client with any Supplier is an independent contract. Travel Haus hereby disclaims any and all liability for any act or omission of any Supplier or any loss incurred by Client as a result of any act or omission of a Supplier whether or not arranged through the Travel Haus.

8.5 Travel Haus shall have no liability to Client for any loss, damage, costs, expenses, or other claims for compensation in the event that Supplier declares bankruptcy before or during Services. Supplier is not obligated to continue providing Services or to provide refunds.

8.6 Travel Haus shall have no liability to Client for any loss, damage, costs, expenses, or other claims for compensation arising from Requests or any instructions supplied by Client which are incomplete, incorrect, or inaccurate or arising from their late arrival or non-arrival, or any Client’s Default.

8.7 Travel Haus shall not be liable to Client or be deemed to be in breach of these T&Cs by reason of any delay in performing, or any failure to perform, any of Travel Haus’ obligations in relation to the Services, if the delay or failure was due to any cause beyond Travel Haus’ reasonable control.

8.8 Except as expressly set out in these T&Cs, all warranties, conditions, and other terms implied by statute or common law are, to the fullest extent permitted by law, excluded from these T&Cs.

8.9 This clause 8 shall survive termination of these T&Cs.

GENERAL

10.1 Privacy and Data Protection: The Services are subject to the Travel Haus privacy policy, incorporated into these T&Cs by reference and set out at the following web address: https://travel-haus.com/privacy-policy, which applies at all times in relation to any data that we collect from Client.

10.2 Assignment and subcontracting:

(a) Travel Haus may at any time assign, transfer, charge, subcontract, or deal in any other manner with all or any of its rights under these T&Cs and may subcontract or delegate in any manner any or all of its obligations under these T&Cs to any third party or agent.

(b) The Client shall not, without the prior written consent of Travel Haus, assign, transfer, charge, subcontract, or deal in any other manner with all or any of its rights or obligations under these T&Cs.

10.3 Waiver:

(a) A waiver of any right under these T&Cs is only effective if it is in writing and shall not be deemed to be a waiver of any subsequent breach or default. No failure or delay by a party in exercising any right or remedy under these T&Cs or by law shall constitute a waiver of that or any other right or remedy, nor preclude or restrict its further exercise. No single or partial exercise of such right or remedy shall preclude or restrict the further exercise of that or any other right or remedy.

(b) Unless specifically provided otherwise, rights arising under these T&Cs are cumulative and do not exclude rights provided by law.

10.4 Severance:

(a) If a court or any other competent authority finds that any provision of these T&Cs (or part of any provision) is invalid, illegal, or unenforceable, that provision or part-provision shall, to the extent required, be deemed deleted, and the validity and enforceability of the other provisions of these T&Cs shall not be affected.

(b) If any invalid, unenforceable, or illegal provision of these T&Cs would be valid enforceable, and legal if some part of it were deleted, the provision shall apply with the minimum modification necessary to make it legal, valid, and enforceable.

10.5 Variation: Travel Haus may vary these T&Cs from time to time and will notify Client of any changes in a timely manner. Notification will be made via email, certified mail to address of record, phone, or video call. Your continued use of Travel Haus’ Services constitutes acceptance of such variations to these T&Cs.

10.6 No partnership: Nothing in these T&Cs is intended to, or shall be deemed to, constitute a partnership or joint venture of any kind between any of the parties, nor constitute any party the agent of another party for any purpose. No party shall have authority to act as agent for, or to bind, the other party in any way.

10.7 Third parties: A person who is not a party to these T&Cs shall not have any rights under or in connection with it.

10.8 Governing law and jurisdiction: These T&Cs, and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims), shall be governed by the laws of the State of Alabama and the parties irrevocably submit to the exclusive jurisdiction of the courts of the State of Alabama.

10.9 Further Assurances: You and Agency will perform any additional acts as necessary to effect these T&Cs and will address together in good faith any unforeseen issues that arise under these T&Cs with a view to mitigating any material adverse impact on either party.

10.10 Entire Agreement: The Conditions constitute the entire terms of the relationship between the parties. There exist no other terms, conditions, warranties, representations, guarantees, promises, undertaking, or inducements of any nature whatsoever regulating the relationship and the Client acknowledges that he/she has not relied on any matter or thing stated on behalf of Travel Haus or otherwise that is not included herein.

10.11 Acknowledgement: You have read and understand the foregoing T&Cs, and agree to them as a condition to visiting our website, booking a reservation through our website, or otherwise utilizing our Services.

10.9 Force Majeure:

10.10 No failure or delay in the performance of any obligation under these T&Cs will be a breach if such failure or delay arises from a force majeure or any cause beyond the reasonable and foreseeable control of Agency, including, without limitation, acts of God, floods, weather conditions, fires, explosions, accidents, war or threats of war (declared or undeclared), acts of terrorism, sabotage, insurrection, riots, strikes, or civil disobedience, sickness, epidemics, pandemics, quarantines, government interventions, defects in machinery or vehicles, delays or other events (collectively, “force majeure”).

10.11 Agency is not liable to you and will not provide any refunds caused by delay or non-performance of any obligation under these T&Cs to the extent any such delay is due to any force majeure.

10.12 If any Suppliers are affected by any force majeure, they may, in their sole discretion, vary or cancel any itinerary or arrangement in relation to your travel without notice.

If an accident occurs and you seek assistance from us, you will be responsible (financially and otherwise) for all alternative travel arrangements.

The Client will be liable for all legal fees and costs in the event that Travel Haus has to engage a lawyer to enforce any of its rights or otherwise.

Airfare

All tickets will be issued for economy class unless otherwise specified. All travel will be round-trip unless otherwise specified. Seat assignments are subject to the airlines’ policies, and may not be able to be made until you are at the airport on the date of departure. Airline tickets booked through the Company may or may not be eligible for frequent flyer mileage accrual. You agree to confirm all bookings with the airline prior to the stated date of departure (recommended is 72 hours in advance).

Direct flights may be non-stop or may involve one or more stopovers (the airline makes a stop but all portions of the flight keep the same flight number). Connecting flights or stopovers may be subject to refueling, maintenance, or crew changes. PLEASE ENSURE THAT YOU SCHEDULE SUFFICIENT TIME FOR CONNECTING OR STOPOVER FLIGHTS THAT ARRIVE AND DEPART FROM ANOTHER TERMINAL OR AIRPORT. Travel to another airport is at the Passenger(s)’ expense. Company will not reimburse Passenger(s) for these additional travel costs or for missed flights.

The Company is unable to specify the type of aircraft used by any airlines or the amenities available on a particular flight. IF AN AIRLINE CANCELS OR DELAYS A FLIGHT, YOU MUST CONTACT THE AIRLINE DIRECTLY TO REBOOK YOUR FLIGHT AND TO ENSURE THAT YOU ARRIVE AT THE AIRPORT ON TIME.

IN ADDITION TO THE LIMITATIONS OF LIABILITY SET FORTH ABOVE, YOU AGREE THAT THE COMPANY IS NOT LIABLE FOR ANY DAMAGES ARISING FROM, OR RELATED TO, ANY AIRLINE TIMETABLE CHANGES, SEATING REASSIGNMENTS, DELAYS, CANCELLATIONS, MISSED CONNECTIONS, MECHANICAL PROBLEMS, INCLEMENT WEATHER, LOST/DELAYED BAGGAGE, SCREENING AND SECURITY DELAYS, REFUSED BOARDING, ACTS OF GOD, TERRORISM, WARFARE, OR FAILURE TO CHECK-IN PROPERLY OR ON TIME.

The company will not provide refunds for trips missed or for delays or cancellations that occur at the discretion of the airline, are due to weather changes, or other causes listed in Section 10 (Force Majeure) below.

B. Prohibited Practices

PASSENGER(S) AGREE THAT THEY WILL NOT DEVIATE FROM THEIR AIRLINE BOOKINGS BY MAKING ANY UNSCHEDULED STOPOVERS.

PASSENGER(S) UNDERSTAND AND AGREE NOT TO ENGAGE IN THE FOLLOWING PROHIBITED PRACTICES:

1. “Hidden-City Ticketing” or “Point Beyond Ticketing.” Hidden-city ticketing occurs when a passenger disembarks an indirect flight at the connection node.

2. “Throwaway Ticketing.” The purchase and use of round-trip tickets for one-way travel only, thereby throwing away the final segment of the ticket.

3. “Back-to-Back Ticketing” The use of two or more different tickets issued at round trip fares to circumvent applicable rules (such as advance purchase/minimum stay requirements).

Passenger further understands that when a ticket is purchased and used in violation of these rules, the Company and any applicable air carrier(s) have the right in their sole discretion to take all actions permitted by law, including, but not limited to, the following:

1. Invalidate the ticket(s);

2. Cancel any remaining portion of your itinerary;

3. Confiscate any unused Flight Coupons;

4. Refuse to board you and to carry your baggage;

5. Assess you for the actual value of the ticket which shall be the difference between the lowest fare applicable to your actual itinerary and the fare actually paid;

6. Delete miles in your frequent flyer account and/or terminate your participation in the frequent flyer program; and/or

7. Take legal action against you.

C. Loss of Tickets for Air and other Modes of Transportation

PASSENGER(S) AGREE TO SAFEGUARD THEIR TICKETS AND BEAR ANY AND ALL COSTS RELATED TO LOSS OR THEFT OF AIRLINE TICKETS OR OTHER TRANSPORTATION TICKETS AND VOUCHERS (INCLUDING, BUT NOT LIMITED TO, BOAT, TRAIN, BUS, HELICOPTER, AND ANY OTHER MODE OF TRANS-PORTATION). IF YOU LOSE YOUR AIR TICKET OR IF YOUR TICKET IS STOLEN, THE COMPANY ADVISES THAT YOU IMMEDIATELY REPORT IT STOLEN TO THE POLICE AND TO THE CARRIER.

Travel Haus, LLC is not responsible for seat assignment modifications caused by airline-implemented schedule changes.

TSA and Global Pre-check are required to be entered 72 hours prior to international departure. It is the responsibility of the traveler to ensure that this is entered and accurate prior to their departure.

PLEASE NOTE THAT IT IS NORMAL PRACTICE FOR AIRLINES TO IMPLEMENT MULTIPLE SCHEDULE CHANGES BEFORE DEPARTURE WHICH IS OUT OF AGENCY CONTROL. WE WILL ASSIST THE BEST WE CAN WITH RE-ASSIGNMENT ACCORDING TO THE AIRLINE’S POLICY BUT BE AWARE THIS IS UNDER AIRLINE CONTROL.
